This Personal Data Protection Policy (“Policy“) applies to the processing of personal data by Elite Links (M) Sdn. Bhd. (Registration No. 201801017105 (1279121-P)) (“Company“, “we“, “our” and/or “us“), pursuant to the requirements under the Personal Data Protection Act 2010 (“PDPA”). The Company is committed to protecting your Personal Data in accordance with the PDPA.
1. General
1.1 This Policy describes how the Company may collect, use, process, disclose and/or transfer (collectively, “Process“) Personal Data (as defined below) and provides information on the obligations and responsibilities of the Company in respect of the Processing of such data.
1.2. For the purposes of this Policy, “Personal Data” shall mean information that relates directly or indirectly to an individual, who is identified or identifiable from that information or from that and other information in the data controller’s possession including any sensitive personal data as defined in the PDPA and expression of opinion about the individual.
1.3. By registering for, activating, accessing, or using the mobile virtual network operator services provided by the Company (collectively, the “Service“), and/or by accessing our website (the “Website”) or mobile application (the “Application“), you agree and consent to the Processing of your Personal Data by the Company and all persons that we consider necessary in order to provide you with the Service and any of the foregoing.
2. Personal Data
2.1 In the course of registering an account with us, accessing the Website or Application, or using the Service, you may provide Personal Data to the Company or the Company may collect Personal Data from you or other sources, including without limitation, from cookies used on the Application or Website, from events that are sponsored, held or associated with us, and information obtained from government databases, credit reporting agencies and/or from third parties. Such Personal Data includes but is not limited to:
name;
identity document details (MyKad/passport number);
contact information (telephone number, email address, residential address);
date of birth;
nationality;
biometric data (facial images);
device and SIM information (IMEI, IMSI, mobile number);
usage data (call records, SMS records, data usage, location data);
billing and payment information;
financial information, including credit worthiness, credit standing, credit history or credit capacity; and
such other information as may be collected in connection with the Service.
2.2 You may choose to limit the processing of your Personal Data, including Personal Data relating to other persons who may be identified from your Personal Data by opting out at any time through the channels set out in paragraph 9 of this Policy.
2.3 The provision of Personal Data is obligatory for the purposes of registering for an account, e-KYC verification, activation, and use of the Service. Failure to provide such Personal Data will result in the Company being unable to process your registration, open your account, activate the Service, or continue to provide the Service to you.
2.4 Where Personal Data relates to a minor under the age of 18, you represent and warrant that you are the parent, legal guardian or person with parental responsibility of such minor and that you are authorised to provide consent in accordance with this Privacy Policy and applicable laws.
3. Purpose of Processing
3.1 By registering for, activating, or using the Service or accessing the Website or the Application, you consent to the Processing of your Personal Data for the following purposes:
the provision, administration, and management of the Service and your Account;
identity verification and eKYC, including the processing of biometric data (sensitive personal data);
billing, payment processing and credit management;
enquiries made by or about you relating to the Service and/or Application;
communication with you regarding the Service, Website and/or Application, including service notifications, updates, administration matters, marketing materials, and/or promotional offers (subject to your right to opt out of marketing communications);
communication with you regarding any products, services, or promotions offered by our business partners;
delivering targeted advertising and promotional campaigns to you;
requesting feedback, conduct survey and research;
compliance with applicable laws, regulations, directions, and orders of the Commission, the Personal Data Protection Commissioner, or any other lawful authority;
fraud prevention and detection;
network planning, maintenance, and quality improvement;
dispute resolution and debt recovery;
enforcement of the Company’s Terms and Conditions;
responding to legal requests and complaints;
any other purposes for which you have provided the Personal Data;
any other incidental purposes related to or in connection with the above; and/or
any other purposes required or permitted by applicable laws.
4. Transfer of Personal Data
4.1 Your Personal Data may be transferred to places outside Malaysia and Processed by other entities within the Company’s group or third party service providers, outside Malaysia. By agreeing to this Policy, you hereby consent to the transfer of your Personal Data to jurisdictions outside of Malaysia in accordance with this paragraph 4.1.
5. Disclosure to Third Parties
5.1 For the purposes described above, the Company may, from time to time, disclose your Personal Data to third parties, including but not limited to other entities within the Company’s group, regulators and law enforcement officials, third party service providers and consultants, mobile network operators, banks and other entities processing payment, insurance providers and any agent or subcontractor acting on the Company’s behalf.
5.2 The Company may disclose your Personal Data to third parties:
to the extent that the Company is required to do so by the law, in connection with any legal proceedings or prospective legal proceedings, to establish, exercise or defend the Company’s legal rights, to any person and/or entity for the purpose of Processing such information on the Company’s behalf;
who provide services to the Company or on its behalf;
other mobile network operators where necessary such as in instances where a porting out is requested or required;
where the Company has a legitimate interest to do so;
for the purposes as stated in this Privacy Policy;
in connection with any merger, sale of company assets, financing, acquisition of our business to another company; and
any other purpose with your specific consent.
6. Security and Integrity of Personal Data
6.1 The Company shall take practical steps to protect your Personal Data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration, or destruction, having regard to the nature of the Personal Data and the potential harm from such events.
6.2 The Company will also take all reasonable steps to ensure that your Personal Data is accurate, complete, not misleading and kept up-to-date by having regard to the purpose, including any directly related purpose, for which the Personal Data was collected and further Processed.
7. Storage and Retention of Personal Data
7.1 The Company shall not retain your Personal Data for longer than is necessary for the fulfilment of the purposes for which it was collected, or as required by applicable law. Upon the expiry of the retention period, your Personal Data shall be securely destroyed, deleted, or anonymised.
8. Access and Correction of Personal Data
8.1 In accordance with the PDPA, you have the right to:
- check whether the Company holds your Personal Data and request access to such Personal Data; and
request the Company to correct any Personal Data which is inaccurate, incomplete, misleading or not up-to-date, except where compliance with a request to such access or correction is lawfully refused in accordance with the PDPA and/ or any other applicable laws.
8.2 Subject to the above, if you wish to check, access, correct, limit or update any Personal Data that you have submitted to us, please contact us in the manner as described in paragraph 9 below.

9.1 If you have any inquiries or complaints with respect to the Processing of Personal Data by the Company, or if you would like to request access to and/or correction of your Personal Data, you may contact the Company’s Personal Data Officer at the following:

9.2 Should you not wish the Company to Process your Personal Data for any of the purposes listed herein, you may withdraw your consent and request us to stop Processing your Personal Data by sending a clearly worded email to the email address provided above. Whilst the Company respects your decision to withdraw your consent, please note that this may affect your access and use of the Service or Application, depending on the nature and scope of your request.
10. Language
10.1 This Policy is available in both the English and Malay language. In the event of any conflict between the two versions, the English version shall prevail.
11. Amendment
11.1 The Company reserves the right to amend, modify or update any of the clauses contained herein in compliance with the PDPA, and for any other purpose deemed reasonably necessary by the Company. You are advised to check our website and/or Application from time to time for the latest version of this Policy.
11.2 By continuing to use the Service, accessing our Website or Application, or communicating with us subsequent to any amendments, modifications and/or updates to this Policy, you confirm you understand and you accept amendments, modifications and/or updates.
12. Consent
12.1 We trust that you have read and understood the statements and terms in this Policy. By providing and continuing to provide your Personal Data to us, registering for or using the Service, communicating with us, or accessing our website and/or Application, you declare that you have read, understood and accepted the statements and terms herein and you agree to the Company’s Processing of your Personal Data in accordance with this Policy.
